Welcome to Professional Web Hosting Network! All we ask in return is that you follow a few simple rules. So please be sure you have read, and understood, these Terms and Conditions. Members who do not follow rules and regulations could find their entire web site removed and/or deleted, possibly without prior notice. The interpretation of these guidelines is at the sole discretion of Professional Web Hosting Network: I. Prohibited Data The following items will not be tolerated and are only acceptable under the terms provided. Illegal Downloads: The use of Warez, mp3 files that you are not the rightful owner of, all cracks, and any other forms of copyrighted software that you are not legally allowed to use or distribute are all strictly prohibited. XXX/Porn Websites: Pornography is strictly prohibited. Spam: Spamming is frowned upon and we take this matter very seriously indeed. Anyone found spamming will be suspended without a refund. This includes: sending advertisements to multiple e-mail addresses at one time unless under the use of an opt-in mailing list, spamming Prowh Hosting in any way, or using forced attacks via email. Viruses: The following items are not allowed, nor will ever be allowed on Professional Web Hosting Network servers: hosting viruses, or sending viruses via e-mail, or allowing users to download files with Trojans, viruses, or any harmful files. If you are looking to host this material, please look somewhere else. Refunds Hosting Refunds are issued within 30 days of your hosting sign-up. Termination of your account for violation of this TOS is permanent grounds for non-refund. Domain registration fees are not available because we do not register them ourselves; rather, a third-party registers the domains. Instead of a refund for domain registration, we will transfer the domain to you. General Information Space: The space on your website is yours to use. Constant monitoring should be done if you plan to allow FTP access to your website for uploading. You take full responsibility for every file located on your website. Hosting of illegal files, or anything not allowed in this TOS agreement will result in suspension of your account until future investigation is made. Account Data Loss: We do create backups for your website files. We are not responsible for these backups and we will not be held accountable for the loss of files. Account Termination: We reserve the right to suspend your account if we suspect you are violating this TOS agreement. We will talk with you before deciding if you are not allowed at Professional Web Hosting Network. Misuse of Resources: The misuse of resources, including but not limited to employing applications that consume excessive CPU time are prohibited. Content: If you are unsure if the content is all right for you to post, please contact us first. We will give a response for your inquire very shortly. Domain Registration: If we register a domain for you, we register it under our company name. If you decide to move your site to another host or just want your domain, you can email us and we will transfer it to you. You should need to have the domain with us for at least one month before asking us to transfer it to you. Keeping your scripts updated: You are responsible to keep your scripts installed on your account updated. If you are running outdated scripts you are taking the risk of allowing your account to be compromised and possible damage to the server. If we find an account that has been compromised we will suspend the account and contact the owner. If this happens more then once we may ask you to find another hosting provider. Termination of Account: Once an account is in payment arrears we reserve the right to suspend the account immediately. After a further unspecified period of time we reserve the right to delete the hosting account removing all files from our servers. We cannot be held responsible for any loss in any way as a result of accounts not being kept in good standing. Note: This agreement is subject to change without your notice. You, as the author of your pages, take full responsibility for its contents. As the author you state your page contains nothing illegal, obscene, pornographic, degrading or abusive to another person, including pages that promote hate group propaganda and child pornography. As the author, you also state that nothing on your page is copyrighted material and that any links to other servers have been approved by that organization. As the author, you also state that nothing on your page infringes on the intellectual property rights of any third party. You agree that Professional Web Hosting Network has the right to remove any page it determines, in its sole discretion, has violated these rules to cancel your membersship and take against you whatever measures will be deemed appropriate including legal action and disclosing information about you to law enforcement authorities and other interested third parties. Members who are in breach of these rules agree to indemnify and hold harmless Professional Web Hosting Network for any loss, claim, damage and expenses (including reasonable attorneys' fees) arising from or in connection with the contents of any personal home pages or of any chat or messages on a bulletin board found to be infringing or illegal. By submitting your pages, you agree to all the above terms.
Professional Web Hosting Network makes no guarantee as to availability of service. To the fullest extent permissible by law, Professional Web Hosting Network excludes all liability with respect to accuracy, content or availability of information on its web site. The materials in this site are provided "as is" and without warranties of any kind, either express or implied. Professional Web Hosting Network does not warrant that the function contained in the materials available on this web site will be uninterrupted or error free, that defects will be corrected, or that this site or the servers that make them available are free of viruses or other harmful components. Any merchandise products or services available to users or members from links from this web site are provided by third parties who are not necessarily affiliated or connected with Professional Web Hosting Network. To the fullest extent permissible by law, Professional Web Hosting Network excludes all liability under any circumstances (including negligence) for any special or consequential damages that result from the use of, or the inability to use, the materials on this site.
